ASUU strike: Court strikes out NANS’ suit against ASUU, FG

The Abuja vacation judge of the National Industrial Court, Hon. Justice Polycarp Hamman on Tuesday, struck out a suit filed by the National Association of Nigerian Students, NANS to compel the Academic Staff Union of Universities, ASUU, and the Federal Government to call off the ongoing strike action.

Justice Polycarp Hamman terminated further proceedings in the matter after it was withdrawn by the Claimant, Umar Lawal.

Umar Lawal had filed the suit for himself and on behalf of NANS against the Academic Staff Union, the Minister of Education, and the Attorney-General of the Federation.

He said the strike action affects students’ right to education under section 18 chapter 2 of the 1999 Constitution as amended. He added that the prolonged strike has caused damage to Nigerian Students as they have lost valuable time and opportunity in their educational and career pursuits.

Furthermore, when the matter came up on Tuesday, Lawal, notified the court that he filed a motion for discontinuance and he premised his decision to withdraw the suit on account of the challenge by the student body which contested his standing as the President of NANS as he had deposed to.

Though the Minister of Education and the Attorney-General of the Federation were not represented, however, counsel to ASUU, Marshal Abubakar Esq. informed the court that he was not opposed to Lawal’s application to withdraw the suit.

Delivering Justice Polycarp Hamman struck out the matter.
